1.1. General provisions
This Contract has the nature of a public offer in accordance with the current legislation of Ukraine (Articles 633, 641 of the Civil Code of Ukraine), for the provision of services to the population (hereinafter – “SERVICE”) by FOP Novosilska M.M., taxpayer identification number (IPN) 3109105100, registered in: Ukraine, Lviv, 33 Bohdana Khmelnytskoho Street, apartment 11, business address: Ukraine, Lviv, 2 Danyla Halytskoho Square.; Ukraine, Uzhhorod, 7 Vozziednannia Street.
License for conducting business activities for medical practice No. 1231/21/M, issued by the Ministry of Health of Ukraine on March 24, 2021 (the validity period of the License is unlimited).
The terms of this Contract are the same and binding for all Patients. The contract defines the procedure and conditions for the provision of qualified services to the order of the patient by the Myroslava Novosilska Aesthetic Medicine Clinic (hereinafter referred to as the “CLINIC”), in accordance with the obtained license for medical practice.
1.2. Evidence of full and unconditional acceptance of the terms and provisions of this Contract (Acceptance), as well as the date of conclusion of the Contract, is the performance by the Patient of actions to fulfill the terms of the Contract, in particular, receiving services (service) and (or) paying for them.
1.3. The Parties guarantee that each of the Parties has the necessary legal capacity, and also all the rights and powers necessary and sufficient for the conclusion and execution of this Contract in accordance with its terms.
1.4. The Clinic carries out its activities in accordance with the current legislation of Ukraine, has all the necessary permits to carry out medical practice related to the execution of the Contract without any restrictions, in accordance with the requirements of the current legislation of Ukraine.
1.5. Familiarization of the Patient with this Contract is carried out by its publication on the Clinic’s website at the address: https://novosilskaclinic.com/
- Subject matter of the Contract
2.1. The Clinic provides paid services according to its activity profile, in accordance with the current Price List (hereinafter – the Price List), approved in accordance with the established procedure by the following categories of the population that applied for medical services (Patients):
2.1.1. adults over 18 years old;
2.1.2. minors under the age of 18 accompanied by their legal representative (parents or guardians);
2.3. The patient voluntarily undertakes to pay for the provided medical services in the manner and under the conditions provided for in this Contract.
- Rights and obligations of the Parties
3.1. The Clinic has the right to:
3.1.1. Receive from the Patient any information necessary to fulfill its obligations under this Contract.
3.1.2. Determine the duration and scope of the provision of Services in accordance with the Patient’s state of health.
3.1.3. Require the Patient to sign an informed consent for medical intervention in the cases and in the manner determined by current regulations.
3.1.4. Require the Patient to comply with the rules of stay in the Clinic, as well as the rules for the provision of Services.
3.1.5. Receive monetary remuneration for the provision of Services under this Contract.
3.1.6. Conduct audio recording of telephone conversations related to the fulfillment of the terms of the Contract by the Parties.
3.1.7. Keep a photo and/or video recording of the process of providing Services with the possibility of using it in case of a conflict regarding the quality of providing Services.
3.1.8. With the consent of the client, take photo and/or video recording of the process of providing the Services and further use the depersonalized results of such recording for advertising, marketing, educational and other purposes that do not contradict the legislation of Ukraine.
3.1.9. Suspend the fulfillment of its obligations, or refuse to fulfill the obligations under this Contract in case of failure to provide or incomplete/ unreliable provision of the necessary information by the Patient, non-fulfillment by the Patient of the requirements necessary for the provision of quality medical care, and demand reimbursement of the actual costs incurred by the Clinic.
3.1.10. In the case of the Patient’s refusal of the Services, which could, in the opinion of the Clinic’s specialists, reduce or eliminate the danger to the Patient’s health, the Clinic has the right to receive from him/her a corresponding note for refusal of medical care, explaining to the Patient in a form accessible to him/her about possible consequences of such refusal for his/her health.
3.2. The Patient has the right to:
3.2.1. Receive medical Services from the Clinic.
3.2.2. Receive available information about his/her health in a form accessible to him/her, including information about the presence of the disease, its diagnosis and prognosis, methods of examination, treatment, about possible options for medical intervention and related risks, possible reactions and complications; about the results of the treatment examination, about health risks in case of refusal of medical intervention.
3.2.3. Refuse medical intervention and sign an informed consent.
3.2.4. Receive information about the cost of Services under this Contract.
3.2.5. Refuse to receive medical Services at the Clinic in case of disagreement with any clause of this Contract, or at any time during the process of receiving the Service with payment for the medical Services actually provided.
3.3. The Clinic undertakes to:
3.3.1. Provide Services to Patients under the terms of this Contract;
3.3.2. Provide the Patient with information about the procedure for providing Services and the opportunity to get acquainted with their cost in advance.
3.3.3. To provide the Patient with information in a form accessible to him/her about his/her state of health, possible methods of diagnosis and treatment of this pathology, about risks and complications that may arise as a result of examination and treatment, the obtained results of examination and treatment, to establish specific types and scope of Services provided ;
3.3.4. To observe the confidentiality of the information received during the fulfillment of the terms of this Contract. According to this Contract, information about the fact of seeking medical help, information about the Patient’s disease and the results of the examination and treatment of the patient is considered confidential.
3.4. The Patient undertakes to:
3.4.1. Provide the Clinic’s medical staff with reliable information about the presence of contraindications, allergies, chronic diseases, contacts with infectious patients, transferred diseases and other information that has a significant impact on the treatment process;
3.4.2. Follow the recommendations of the attending physician regarding the treatment process;
3.4.3. Properly fulfill the terms of this Contract and inform in a timely manner about any circumstances that prevent the Patient from fulfilling this Contract;
3.4.4. Inform the Clinic in advance about the need to cancel or change the time of receiving the medical Service assigned to him/her.
3.4.5. Observe the rules of stay in the Clinic;
3.4.6. Report in a timely manner the deterioration of well-being and condition that occurred during the provision of medical Services;
3.4.7. Agree with the attending physician on the use of any therapeutic drugs, medicines, medicinal herbs, ointments, etc.
3.4.8. In case of deterioration of the Patient’s condition and impossibility to visit the doctor (evening, night time, weekends, etc.), seek urgent medical help at the emergency and emergency service and / or the nearest available medical facility.
3.4.9. Read the Price List on the website before receiving the Service.
3.4.10. Pay for the Services.
- Cost of Services and payment procedure
4.1. Payment for the services provided is made by cash or non-cash settlement in the national currency (Hryvnia).
4.2. The Clinic has the right to unilaterally revise the prices for the Services provided under this Contract and introduce additional Services with their cost displayed on the Clinic’s website. The Patient is obliged to familiarize himself/ herself with the cost of the Service before receiving it.
4.3. If the Patient refuses to continue the examination or treatment, the amount for the Services actually provided is deducted from the Patient. In case of prepayment, the balance of the amount previously paid for the Services is returned to the Patient by cash or non-cash payment within 30 working days;
4.4. In the event that the Clinic is unable to fulfill its obligations under this Contract due to the Patient’s fault, including when he violates medical prescriptions, etc., the Clinic has the right to refuse further provision of Services to such a Patient;
4.5. In case of refusal to provide Services in accordance with clause 4.4. of this Contract, the Clinic does not return the cost of paid Services to the Patient;
4.6. If the Patient is unable to accept the Services for which he/she has subscribed at the date and time agreed upon by the Parties, the subscription for the Service will not be refunded. In this case, the Parties undertake to make efforts to postpone the provision of the Service to a date and time convenient for both Parties.
- Service provision procedure
5.1. The Clinic accepts Patients by appointment.

- Liability of the Parties
6.1. The Parties are responsible for non-fulfillment or improper fulfillment of the terms of this Contract in accordance with the legislation of Ukraine.
6.2. The Clinic is released from responsibility for damage to the Patient’s health or non-recovery of the Patient in the event that the above events occurred through no fault of the Clinic, in particular, as a result of:
6.3.1 failure to provide or incomplete/unreliable provision of the necessary information by the Patient;
6.3.2. non-compliance by the Patient with recommendations;
6.3.3. untimely notification of deviations and violations in the state of health;
6.3.4. refusal of the recommended intervention;
6.3.5. termination of treatment at the initiative of the Patient;
6.3.6. non-fulfillment of other conditions of this Contract.
- Modifications and additions to the Contract
7.1. This Contract may be changed by the Clinic unilaterally. Changes to the Contract are published on the Clinic’s website. Changes enter into force from the moment of their public posting.
7.2. In case of unilateral changes made by the Clinic, the Patient has the right to withdraw from the Contract by paying the actually provided Services and costs of the Clinic.
- Duration of the Contract
8.1. This Contract of public offer enters into force from the day of its public placement and remains in effect until the Parties fulfill their obligations.
- Additional provisions
9.1. The Patient is informed about the possibility of receiving free medical care in communal health care facilities on the territory of Ukraine.
9.2. The amount of consumables and medicines purchased by the Patient independently is not included in the account of the Services provided.
9.3. The Patient’s consent to the Service and the fact of receiving it simultaneously means the Patient’s consent to pay for this Service.
9.4. Acceptance of this Contract is the Patient’s consent to the collection and processing of the provided personal data* in any way provided for by the Law “On the Protection of Personal Data”, including entering them into the personal data base of the Clinic for the purpose of fulfilling this contract.
*Personal data is any information about the Patient, including, but not limited to, last name, first name, patronymic, date and place of birth, address, telephone, information about health, the presence of diseases and diagnoses, examination data, as well as other information received by the Clinic when fulfilling the terms of the Contract.
9.5. The Patient gives the Clinic the right to notify him/her of any information related to the Contract, Services, promotions, news, etc. by mail, e-mail, telephone or SMS messages.
